Innovative Approaches In Alternative Dispute Resolution: A Focus On Family Disputes

ABSTRACT


Alternative Dispute Resolution (ADR) has long been a vital part of India's approach to conflict resolution, with its roots tracing back to ancient times. This paper explores the innovative methods of ADR, focusing on its application in family disputes, particularly in the context of matrimonial conflicts. In contrast to traditional litigation, ADR offers a more amicable, faster, and cost-effective means of resolving disputes while preserving relationships. The study highlights key ADR techniques such as mediation and conciliation, examining their advantages in promoting understanding and cooperation between disputing parties. Furthermore, the paper discusses the legislative framework that supports ADR, including the Family Courts Act, 1984, and the various legal provisions designed to encourage reconciliation in family disputes. By reviewing relevant judicial decisions, the paper demonstrates how courts in India have reinforced the importance of reconciliation and non-adversarial methods in family law proceedings. Through this exploration, the research emphasizes the role of ADR in enhancing access to justice, reducing societal tension, and fostering family harmony. The findings suggest that ADR is not only a practical solution but also a culturally aligned mechanism for resolving disputes in today's complex societal landscape.
