ABSTRACT


India has not just brought forth significant provisions and incorporated in the Constitution but has also enacted various specific laws to control and abate environmental pollution. It was seen that post bringing into force the Constitution, efforts in the field of environmental jurisprudence have canvased unique characteristics of the legal order in India particularly during the late 1970s and throughout the 1980s and early 1990s. Within the last few decades, the development of environmental jurisprudence in India leading to the virtual creation of a fundamental right to a clean environment, has been remarkable in light of the changes brought under constitutional law. However, with the change in time, increased industrialisation and change in living standards alongside the developmental goals of the country, pollution and environmental degradation along with resource depletion have increased manifold in spite of the legislative measures of the government.


The current paper aims at discussing within its scope the importance of the Directive Principles of the State Policy and its implementation in India through laws, rules, regulations and orders along with the judicial Activism that has accelerated the efforts in the sphere. The paper also discusses the various international conventions on environment protection that have been adopted by India as a step towards implementing the DPSPs. The paper further attempts to discuss the various programmes and initiatives that the government has introduced in the last decade towards achieving its sustainable and developmental goals.
